الشروط والأحكام
1. Acceptance of Terms
This is a binding agreement between you ("you", "User") and Brandit Marketing & Promotions Private Limited (CIN U74900MH2013PTC245049), operating as BRANDit ("BRANDit", "we", "us"), governing your access to and use of branditindia.com and its content (the "Site"). By using the Site, you accept these Terms in full. If you do not agree, do not use the Site.
2. Changes to These Terms
We may update these Terms at any time to reflect changes in our services, legal requirements, or business operations. Changes take effect once posted on this page, and continued use of the Site after that means you accept them. Please check this page periodically.
3. Use of This Website
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You must not:
- Submit false, inaccurate, or misleading information through any form on the Site
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems
- Introduce viruses, malware, or any other harmful code
- Reverse engineer, decompile, or disassemble any part of the Site
- Scrape, copy, or republish Site content for commercial purposes without our written permission
- Use the Site in any way that interrupts, damages, or impairs its operation
We may suspend or restrict your access to the Site, without notice, if we reasonably believe these Terms have been violated.
4. Intellectual Property
All content on the Site — including text, graphics, logos, images, case studies, and design — is owned by or licensed to BRANDit and protected by applicable copyright, trademark, and other intellectual property laws. You may view and share Site content for personal, non-commercial reference. You may not reproduce, modify, distribute, or create derivative works from any Site content without our prior written consent. All trademarks, logos, and brand names of our clients appearing on the Site remain the property of their respective owners and are used with permission or under fair representation of our work for them.
5. Third-Party Links
The Site may link to third-party websites (including our clients' and partners' sites) for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any linked site. Visiting a linked site is at your own risk, and we recommend reviewing its own terms and privacy policy.
6. Disclaimer
The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, or fitness for a particular purpose. While we take reasonable care to keep the Site accurate and available, we do not guarantee uninterrupted access or that the Site will be free of errors or viruses. Visitor numbers, market data, or results referenced in case studies and marketing materials are illustrative of past work and are not a guarantee of future outcomes for any prospective client.
7. Limitation of Liability
To the fullest extent permitted by law, BRANDit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, business, goodwill, or data, arising out of or in connection with your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages. Our total cumulative liability to you arising from or related to the Site shall not exceed ₹1,000 (Indian Rupees One Thousand). Nothing in this clause limits liability that cannot be excluded under applicable Indian law, including liability for fraud or wilful misconduct.
8. Indemnification
You agree to indemnify and hold BRANDit, its employees, and affiliates harmless from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
9. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
10. General
Entire agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and BRANDit regarding use of the Site, and supersede any prior agreements on this subject. A separate signed agreement between BRANDit and a client governs that specific engagement and takes precedence over these Terms for matters it covers.
Severability — If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.
No waiver — Our failure to enforce any right or provision does not waive that right.
